These Terms of Service ("Terms") govern access to and use of the websites, applications, call-tracking tools, attribution features, Google Ads integrations, and related services made available under the Callswala name (collectively, the "Services").
By creating an account, accessing the Services, connecting a third-party account, or using Callswala on behalf of an organization, you agree to these Terms. If you use the Services on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms.
The Services are provided by Callswala.com, operating as Callswala ("Callswala," "we," "us," or "our").
1. Description of the Services
Callswala provides a multi-tenant, web-based platform that may allow authorized customers to:
- Assign or administer tracking phone numbers.
- Route, log, review, and evaluate inbound calls.
- Attribute calls to websites, marketing sources, and customer-defined campaigns.
- Install Dynamic Number Insertion or other website tracking technology.
- Record, transcribe, tag, or qualify calls when those features are available and enabled.
- Connect authorized Google Ads accounts through Google OAuth.
- Retrieve Google Ads account identifiers and existing conversion actions.
- Upload qualifying phone-call outcomes to Google Ads as offline conversions.
- Review call data, conversion-upload status, and related reports or exports generated from Callswala data.
Features vary by account configuration, subscription, availability, and third-party integrations. Callswala does not use its Google Ads integration to create, modify, pause, or delete campaigns, ads, ad groups, keywords, bids, or budgets.
2. Eligibility and Account Registration
You must be legally capable of entering into a binding agreement and may use the Services only for lawful business purposes.
You agree to provide accurate account and organization information, keep that information current, protect login credentials, and promptly notify us of suspected unauthorized access.
You are responsible for activity occurring through your account and for the acts or omissions of users you invite, authorize, or permit to access your organization.
3. Organization Administration and User Permissions
Customer administrators are responsible for managing organization membership, assigning appropriate roles, and ensuring that users receive only the access necessary for their responsibilities.
Resellers, agencies, consultants, or other representatives may access an organization only when they have been properly authorized by the relevant customer. Access to one customer organization does not authorize access to another organization or to unrelated Google Ads accounts.
We may rely on instructions provided by an authorized organization administrator unless applicable law or our security procedures require otherwise.
4. Google Ads Authorization and Integration
When you connect a Google Ads account, you authorize Callswala to access and process the Google Ads information reasonably necessary to provide the integration features you select.
The integration may use the Google Ads OAuth permission https://www.googleapis.com/auth/adwords to:
- Identify advertiser accounts accessible to the authorized Google user.
- Display advertiser account names, customer IDs, and relevant manager-account information.
- Retrieve existing conversion actions for customer configuration.
- Upload qualifying offline click conversions to a customer-selected advertiser account and conversion action.
- Maintain connection status, conversion mappings, operational records, and upload results.
You represent that you own, manage, or otherwise have valid authorization to connect each Google Ads account and submit conversion data to it. You are responsible for ensuring that all Google Ads settings, selected conversion actions, customer IDs, and uploaded information are accurate and authorized.
You may disconnect the Google Ads integration through Callswala where available or revoke access through your Google account settings. Disconnecting or revoking access may disable integration functionality and will not necessarily remove conversion data previously submitted to Google.
Google Ads and other Google services remain subject to Google's own terms, policies, availability, and technical requirements. Callswala is an independent service and is not Google or endorsed by Google merely because it integrates with Google services.
5. Customer Data and Instructions
"Customer Data" means information submitted to, collected through, or processed by the Services for a customer organization, including call records, campaign mappings, tracking identifiers, call recordings where enabled, lead classifications, and conversion-related information.
As between Callswala and the customer, the customer retains its rights in Customer Data. The customer grants Callswala a limited, nonexclusive right to host, process, transmit, reproduce, and otherwise use Customer Data as reasonably necessary to provide, support, secure, and improve the Services; follow the customer's lawful instructions; comply with applicable law; and enforce these Terms.
You represent that you have obtained all rights, permissions, notices, and consents necessary for Callswala to process Customer Data as described in these Terms and our Privacy Policy.
6. Call Recording, Caller Notice, and Telecommunications Compliance
You are solely responsible for determining whether call recording, transcription, call monitoring, tracking, forwarding, and related features are lawful in the jurisdictions where you and your callers are located.
When required, you must provide clear notice and obtain any necessary consent before recording, monitoring, or otherwise processing a call. This may include consent from one or all parties to a call, depending on applicable law.
You are also responsible for complying with applicable telecommunications, telemarketing, robocall, text-message, caller-identification, consumer-protection, privacy, and do-not-call requirements, including any obligations relating to outreach or follow-up communications conducted through or in connection with the Services.
Callswala does not provide legal advice or guarantee that a particular call-recording, tracking, advertising, or communications practice is lawful.
7. Website Tracking and Consent
If you install Dynamic Number Insertion, cookies, pixels, scripts, or other tracking technology on a website, you are responsible for:
- Having authority to install and operate the technology on that website.
- Providing accurate privacy and cookie notices.
- Obtaining website-visitor consent where required by law.
- Managing any customer-configured consent or opt-out preferences.
- Ensuring that advertising identifiers and personal information are collected and processed lawfully.
- Maintaining compliance with applicable advertising-platform and browser requirements.
You must not configure Callswala to collect sensitive information beyond what is reasonably necessary for the selected Services or in violation of law or third-party policies.
8. Offline Conversions and Attribution
Callswala may upload a conversion when the customer has connected an eligible Google Ads account, selected a conversion action, and configured a rule that a tracked call satisfies.
Conversion attribution depends on factors outside Callswala's control, including the availability of a valid advertising identifier, the customer's website configuration, visitor consent, ad-platform settings, browser restrictions, Google Ads eligibility requirements, and third-party service availability.
If a supported enhanced-conversion feature is enabled, any first-party identifier must be collected and used in accordance with applicable law, Google requirements, and the customer's representations and consents.
Callswala does not guarantee that every call will be attributed to an advertisement, that Google will accept every uploaded conversion, or that any conversion will appear in a customer's account within a particular time.
9. Acceptable Use
You agree not to:
- Access an account, organization, Google Ads account, phone number, or data set without authorization.
- Upload inaccurate, misleading, fraudulent, duplicate, or fabricated conversions.
- Use the Services to violate privacy rights, communications laws, advertising policies, or intellectual-property rights.
- Record or monitor communications without required notices or consent.
- Use the Services for spam, unlawful telemarketing, harassment, deceptive practices, or prohibited surveillance.
- Attempt to bypass access controls, tenant isolation, usage limits, security measures, or Google OAuth restrictions.
- Reverse engineer, scrape, disrupt, overload, or interfere with the Services except where applicable law expressly permits the activity.
- Upload malware, malicious code, or material designed to compromise the Services or third-party systems.
- Resell or sublicense access except as expressly authorized by your agreement with Callswala.
- Use Google user data obtained through the Services for purposes prohibited by applicable Google policies.
We may investigate suspected violations and take appropriate action, including restricting or suspending access.
10. Fees, Subscriptions, and Billing
If you purchase a paid subscription or use a feature subject to usage-based charges, applicable fees, billing frequency, usage allowances, renewal terms, and taxes will be identified in your order form, subscription plan, invoice, or other written agreement.
Unless otherwise stated in the applicable commercial agreement, you are responsible for all authorized charges, applicable taxes, and third-party telecommunications or service costs associated with your account.
Any cancellation, refund, credit, trial, renewal, or late-payment terms will be governed by the applicable subscription agreement.
11. Third-Party Services
The Services may depend on third-party providers, including Google Ads, telecommunications carriers, hosting providers, authentication services, payment processors, and other technology vendors.
Third-party services may change, become unavailable, impose new requirements, suspend an account, reject an upload, or otherwise affect the operation of Callswala. Your use of a third-party service may also be governed by that provider's terms and privacy policy.
We are not responsible for third-party systems, outages, account decisions, policy changes, or actions outside our reasonable control.
12. Intellectual Property
Callswala and its licensors retain all rights, title, and interest in the Services, software, user interface, documentation, branding, and other proprietary materials, excluding Customer Data and third-party materials.
Subject to these Terms and any applicable subscription, we grant you a limited, revocable, nonexclusive, nontransferable right to access and use the Services for your authorized business purposes during your subscription or authorized access period.
You may not copy, distribute, modify, sell, lease, or create derivative works from the Services except as expressly permitted by us or applicable law.
13. Confidentiality
Each party will use reasonable care to protect nonpublic information received from the other party and will use that information only as reasonably necessary to perform its obligations, exercise its rights, or comply with applicable law.
Confidentiality obligations do not apply to information that becomes public without breach, was already lawfully known, is independently developed, or is rightfully obtained from a third party without a confidentiality obligation.
14. Privacy and Security
Our collection and use of information are described in the Callswala Privacy Policy. You agree to review that policy and to provide appropriate privacy disclosures to your own users, website visitors, and callers.
We use reasonable measures intended to protect the Services and customer information, but no online service can guarantee absolute security. You are responsible for maintaining secure user credentials and appropriate account permissions.
15. Suspension and Termination
We may suspend, restrict, or terminate access when reasonably necessary to:
- Respond to a security threat, fraud, or suspected abuse.
- Comply with law, a court order, or a valid governmental request.
- Address nonpayment or a material breach of these Terms.
- Respond to a third-party provider's suspension, policy requirement, or revoked authorization.
- Prevent harm to customers, callers, the Services, or third parties.
You may stop using the Services or request account closure according to your subscription agreement and applicable account procedures.
After termination, access to the Services and connected integrations may end. Data export, deletion, retention, and post-termination access will be handled according to the applicable agreement, our Privacy Policy, legal requirements, and the customer's account configuration.
16. Disclaimers
To the maximum extent permitted by applicable law, the Services are provided "as is" and "as available." Callswala disclaims all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, noninfringement, and uninterrupted availability.
We do not guarantee uninterrupted service, complete call attribution, call-routing availability, advertising results, lead quality, Google Ads approval, successful conversion upload, or any specific return on advertising spend.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
17. Limitation of Liability
To the maximum extent permitted by applicable law, Callswala and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost business opportunities, advertising losses, or reputational harm arising out of or relating to the Services.
These limitations do not apply where prohibited by law.
18. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Callswala and its affiliates, employees, and service providers against third-party claims, liabilities, damages, and reasonable expenses arising from your unlawful use of the Services, unauthorized Google Ads access, improper call recording, failure to obtain required consent, inaccurate conversion submissions, or breach of these Terms.
19. Governing Law and Dispute Resolution
These Terms will be governed by the laws of Telangana, India, without regard to conflict-of-law principles.
Unless a separate written agreement provides otherwise, disputes will be brought in the competent courts located in Hyderabad, Telangana, India, subject to any mandatory rights or procedures that apply under law.
20. Changes to the Services or Terms
We may update the Services or these Terms from time to time. If a change is material, we will provide notice through the Services, email, an updated effective date, or another reasonable method where required.
Continued use of the Services after updated Terms take effect constitutes acceptance to the extent permitted by law. If you do not agree to updated Terms, you must stop using the Services and follow any applicable cancellation procedures.
21. General Terms
These Terms, together with an applicable order form, subscription agreement, data-processing agreement, and Privacy Policy, form the agreement between you and Callswala concerning the Services.
If any provision is found unenforceable, the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent, except as otherwise permitted by a written agreement or applicable law.
